Prohibited Blood Alcohol Levels In Kentucky

Drivers under 21 – BAC 0.02 or above

Adult drivers – BAC 0.08 or above

Aggravating Circumstances Result in Enhanced Penalties

  • Operating a motor vehicle in excess of thirty (30) miles per hour above the speed limit;
  • Operating a motor vehicle in the wrong direction on a limited access highway;
  • Operating a motor vehicle that causes an accident resulting in death or serious physical injury as defined in KRS 500.080;
  • Operating a motor vehicle while the alcohol concentration in the operator’s blood or breath is 0.18 or more as measured by a test or tests of a sample of the operator’s blood or breath taken within two (2) hours of cessation of operation of the motor vehicle;
  • Refusing to submit to any test or tests of one’s blood, breath, or urine requested by an officer having reasonable grounds to believe the person was operating or in physical control of a motor vehicle in violation of subsection (1) of this section; and
  • Operating a motor vehicle that is transporting a passenger under the age of twelve (12) years old

  DUI PENALTIES IN KENTUCKY (NEW 2016 KY LAW Amends the look back period to 10 years from the date of the previous offense).

DUI 1st OFFENSE
DUI 1st Offense– within 10 year period – Fine $200- $500 and/or Jail 48hrs – 30days and 30-day – 120-day driver’s license suspension

· Aggravating Circumstances 1st Offense– Mandatory term of imprisonment four (4) days which term shall not be suspended, probated, conditionally discharged, or subject to any other form of early release.

DUI 2ND OFFENSE
DUI 2nd Offense–  within 10 year period – Fine $300-$500 and Jail 7days-6 months and in addition may be sentenced to community labor 10 days-6 months. Minimum jail term cannot be suspended and 1 year – 18-month driver’s license suspension

· Aggravating Circumstances 2nd Offense -Mandatory minimum term of imprisonment (14) days, which term shall not be suspended, probated, conditionally discharged, or subject to any other form of early release.

DUI 3rd OFFENSE
DUI 3rd Offense – within a 10 year period – Fine $500-$1,000 and Jail 30 days- 12 months and in addition maybe sentenced to community labor 10 days- 12 month. Minimum jail term cannot be suspended and 2-year – 36-month driver’s license suspension

· Aggravating Circumstances 3rd Offense – Mandatory minimum term of imprisonment sixty (60) days can not be suspended, probated, conditionally discharged, or subject to any other form of early release.

DUI 4th Offense – within a 10 year period – Class D felony.
Aggravating circumstances 4th Offense – Mandatory minimum term of imprisonment shall be two hundred forty (240) days, which term shall not be suspended, or probated.

Refusal of Breathalyzer

  • Driver’s license revocation until court case is resolved
  • If convicted double the minimum jail sentence
