For Defendants:

  •  If you have been accused of domestic violence, contact Aleksander Law Office to discuss your case.

  • When an EPO has been filed against you: If after review the court determines that the allegations contained in the petition do not indicate the presence of an immediate and present danger of domestic violence and abuse, you must be given notice and given a hearing within 14 days. At that time, the court may issue a DVO. · If you violate the terms and conditions of your EPO or DVO you can be arrested without a warrant and will undergo a contempt hearing.
  • Violation of a domestic violence court order is a Class A Misdemeanor.
  • If you are found in civil contempt, you will not be prosecuted again for violating a court order, however, you may still be criminally prosecuted for the underlying domestic violence.

What is domestic violence?

In Kentucky, “Domestic violence and abuse” means physical injury, serious physical injury, sexual abuse, assault, or the infliction of fear of imminent physical injury, serious physical injury, sexual abuse, or assault between family members or members of an unmarried couple KRS 403.720.
